1. Acceptance of Terms

Welcome to WebInTouch (“Company”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the website https://webintouch.net (the “Site”) and all services, content, and functionality offered on or through the Site (collectively, the “Services”).

By accessing, browsing, or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy (which is incorporated herein by reference), and all applicable laws and regulations.

If you do not agree to all of these Terms, you are prohibited from using the Site and must discontinue use immediately.

2. Intellectual Property Rights

The Site and its original content, features, and functionality are owned by WebInTouch and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not modify, reproduce, distribute, or create derivative works of our proprietary content without our express written permission.

3. User Accounts

When you create an account with us, you must provide accurate and complete information. You are solely responsible for safeguarding your account password and for any activities under your account. You must notify us immediately of any unauthorized use of your account.

4. Services and Payment Terms

  • Service Description: We offer web design, App development, digital marketing services. The specific details, scope, and deliverables for each service (“Project”) will be outlined in a separate proposal, statement of work (“SOW”), or service agreement.
  • Pricing: All prices are quoted in US dollar($USD),Australian dollar($AUD),Canadian dollar($CAD),GBP(£) and Euro(€). We reserve the right to change our prices at any time. Changes will not affect projects already agreed upon with a signed SOW and deposit.
  • Payment Schedule: For most projects, a non-refundable deposit is required to begin work. Subsequent payments are due according to the milestones outlined in the SOW. All invoices are due upon receipt unless otherwise stated. Accounts that are overdue may be subject to a late fee or suspension of services.

5. Cancellation & Refund Policy

This section outlines our policy regarding the cancellation of services and eligibility for refunds.

A. Custom Service Projects (e.g., Website Design/Development):

  • Client-Initiated Cancellation: The Client may cancel a project at any time by providing written notice to WebInTouch.
  • Refund Eligibility: Upon cancellation, the Client is responsible for paying for all hours of work completed and any expenses incurred up to the date of cancellation, calculated at our standard hourly rate of  USD $12/hour. Any portion of the prepaid amount that exceeds the cost of work completed will be refunded to the Client. The initial deposit is non-refundable.
  • Company-Initiated Cancellation: We reserve the right to cancel a project for non-payment, failure of the Client to provide necessary materials or feedback in a timely manner, or if the working relationship is deemed unproductive. In such a case, the same calculation for work completed will apply, and a refund for any unused prepaid amount will be issued.

B. Recurring/Monthly Services (e.g., Hosting, Maintenance, SEO):

  • Cancellation: Recurring services can be canceled at any time by providing written notice at least [e.g., 10] business days before the next billing cycle.
  • Refunds: These services are billed monthly in advance. Cancellation will stop future billing. No refunds will be issued for the current billing period in which the cancellation occurred, and services will continue until the end of that paid period.

C. Digital Products (e.g., Templates, eBooks):

  • Due to the intangible and immediately accessible nature of digital products, all sales are final, and we do not offer refunds or exchanges unless the product is fundamentally defective and unable to be downloaded or used.

D. General Refund Process:
All refund requests must be submitted in writing to [[email protected]]. Approved refunds will be processed within [e.g., 14] business days and issued to the original method of payment.

6. Disclaimer of Warranties; Limitation of Liability

The Site and all Services are provided on an “AS IS” and “AS AVAILABLE” basis. Your use of the Site and Services is at your sole risk. WebInTouch makes no warranties, expressed or implied, and hereby disclaims all warranties including without limitation implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

In no event shall WebInTouch, its directors, employees, or agents, be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site or Services.

7. Indemnification

You agree to indemnify and hold harmless WebInTouch and its affiliates from any claims, damages, liabilities, and expenses arising from your use of the Site, violation of these Terms, or infringement of any third-party rights.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last Updated” date. Your continued use of the Site after changes constitutes acceptance of the new Terms.
